Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TrustyGorilla platform and website (“Services”), operated by GrownFox Studio. By using our Services you agree to these Terms.

1. Acceptance of Terms

By accessing TrustyGorilla you confirm that you are at least 16 years old and have the legal authority to enter into these Terms on behalf of yourself or your organisation.

2. Description of Service

TrustyGorilla provides a feature management platform including feature flags, remote configuration, experimentation, and related developer tooling, available as a hosted cloud service and a self-hostable solution.

3. Accounts

• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of any unauthorised use of your account.
• You may not share account credentials or create accounts on behalf of others without authorisation.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to any part of the Services or related systems.
• Interfere with or disrupt the integrity or performance of the Services.
• Reverse-engineer, decompile, or disassemble any portion of the Services (except where permitted by law).
• Resell or sublicense access to the Services without prior written permission.

5. Intellectual Property

All content, trademarks, and technology within the Services are owned by or licensed to TrustyGorilla / GrownFox Studio. Nothing in these Terms grants you a right to use our trademarks, logos, or brand names without express written consent.

Our open-source SDKs are licensed under their respective open-source licences (see each repository for details).

6. Your Content

You retain ownership of any data or content you upload to the Services (“Customer Data”). You grant us a limited licence to host, process, and transmit Customer Data solely to provide the Services.

7. Subscription & Billing

• Paid plans are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or stated in our refund policy.
• We reserve the right to change pricing with 30 days notice.
• Failure to pay may result in suspension or termination of your account.

8. Free Tier & Trial

We may offer a free tier or trial period subject to usage limits. We reserve the right to modify or discontinue free tiers at any time with reasonable notice.

9. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services ceases and we may delete your data after a reasonable retention period.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Services will be error-free or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by law, TrustyGorilla and GrownFox Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless TrustyGorilla and GrownFox Studio from any claims arising from your use of the Services or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which GrownFox Studio is incorporated. Any disputes shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or notice on the platform. Continued use after the effective date constitutes acceptance.
